This step serves as the foundation for tailoring the design to their exact specifications. In "Tailoring," the third step, we infuse the design with the client's energy and aura, personifying their personality and message from within. This holistic approach ensures that each design reflects the unique essence of the client. Finally, in "Revisions," we offer the opportunity for adjustments based on client feedback. Depending on the project and package chosen, a specified number of revisions allows us to fine-tune the design until it meets and exceeds the client's expectations. **DESIGN Terms and Conditions**
1. **Scope of Services:** These terms and conditions ("Terms") govern the provision of graphic design services ("Services") by T.H.R.Y. DREAM. CREATE. INSPIRE. ("Company") to the customer ("Customer").
2. **Orders:** Customers may place orders for graphic design services either online through the Company's website or by contacting the Company directly. All orders are subject to acceptance by the Company.
3. **Artwork and Designs:** Customers are responsible for providing clear and concise instructions, as well as any necessary materials or content ("Materials") to be used in the design process. The Customer warrants that they have the necessary rights and permissions to use the Materials and that they do not infringe upon any third-party rights. The Company reserves the right to refuse to work on any project that it deems to be inappropriate, offensive, or infringing upon intellectual property rights.
4. **Payment:** Payment for Services shall be made in accordance with the pricing and payment terms specified by the Company. Payment is due in full upon acceptance of the project estimate unless otherwise agreed upon in writing by the Company. Failure to make timely payment may result in delays or cancellation of the project.
5. **Ownership and Intellectual Property:** Upon completion of the Services and receipt of full payment, the Customer shall own the final approved design(s) ("Deliverables"). The Company retains all rights to any preliminary designs, concepts, or drafts created during the design process. The Customer may not reproduce, distribute, or modify any Deliverables produced by the Company without the Company's prior written consent.
6. **Revisions:** The Company will provide the Customer with the opportunity to request revisions to the Deliverables based on the initial design concept provided. The number of revisions included in the project fee will be specified in the project estimate. Additional revisions may be subject to additional fees.
7. **Confidentiality:** The Company agrees to keep all Materials provided by the Customer confidential and to use them only for the purpose of completing the Services. Likewise, the Customer agrees to keep all communications, concepts, and drafts shared by the Company confidential.
8. **Limitation of Liability:** The Company's liability for any claims arising out of or related to the Services shall be limited to the total amount paid by the Customer for the Services. In no event shall the Company be liable for any indirect, incidental, special, or consequential damages.
9. **Governing Law:** These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction]. Any disputes arising out of or related to these Terms shall be resolved exclusively by the courts of [Your Jurisdiction].
10. **Amendment and Waiver:** These Terms may be amended or modified by the Company from time to time in its sole discretion. Failure by the Company to enforce any provision of these Terms shall not constitute a waiver of such provision or any other provision.
